Welcome to Exotic Pro (“Exotic Pro,” “we,” “us,” “our”). We operate www.exoticp.com and related features, tools, products, and services (collectively, the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

By visiting, interacting with, or using the Services, you agree to these Terms of Service (the “Terms”) and our Privacy Policy. If you do not agree, please do not use the Services.

1. Access & Accounts

  • Age & authority. You represent that you are at least the age of majority in your jurisdiction and are authorized to enter into these Terms.
  • Account information. You agree to provide accurate, current, and complete information and to keep it updated.
  • Security. You are responsible for safeguarding your login credentials and all activity under your account. We strongly recommend strong passwords and two-factor authentication (2FA). You may not sell or transfer your account.

2. Changes to These Terms

We may update these Terms at any time by posting the revised version and updating the “Last Updated” date. We will provide notice of material changes as required by law. Your continued use after changes take effect constitutes acceptance.

3. About Our Products — Authorized Reseller Notice

Exotic Pro is an independent reseller. We are not affiliated with, authorized by, sponsored by, or endorsed by the brands or manufacturers whose products we sell, unless we expressly state otherwise. All products we sell are genuine goods sourced through legitimate channels, and are resold consistent with the “first-sale” doctrine.

  • Trademarks. All brand names, trademarks, logos, and product images are the property of their respective owners. They are used only to identify the genuine products we offer for sale. Their use does not imply any affiliation with or endorsement by the trademark owner.
  • Condition. Unless a listing expressly states otherwise, products are sold new and in their original, sealed manufacturer packaging. We do not sell used or open-box items except where clearly disclosed on the product listing.
  • Expiration dating. For applicable health, beauty, and consumable products, we track expiration dates and display them on the product page where available. If you need more detail before purchasing, contact us.

4. Product Display, Pricing & Availability

We work hard to present products accurately, but display may vary by device and settings. Descriptions, specifications, availability, and pricing may change without notice. We may limit quantities or discontinue items at our discretion.

5. Orders & Acceptance

When you place an order, you make an offer to purchase. We may accept or decline any order at our discretion (including for suspected fraud, pricing or stock errors, address issues, or restricted-product limitations). We must receive and process payment before acceptance. If we cancel or modify an order, we’ll attempt to notify you using the contact details you provided. Your purchases are subject to our Return & Refund Policy.

6. Prices, Billing & Taxes

Prices, promotions, and discounts may change without notice. The price shown in your order confirmation is the price in effect at purchase, exclusive of taxes, shipping, handling, customs, and import charges unless stated otherwise. You agree to provide current, complete, and accurate payment information and authorize us (and our payment processors) to charge your selected payment method for all amounts due.

7. Shipping, Title & Risk of Loss

See our Shipping Policy for carriers, costs, and timelines. Delivery times are estimates only. Once an order is tendered to the carrier, title and risk of loss pass to you. We are not liable for carrier delays, customs processing, or events outside our control.

8. Returns, Refunds & Exchanges

Returns, refunds, and exchanges are governed by our Return & Refund Policy. In general, eligible items must be returned within 30 days in original, sealed condition. For health and hygiene reasons, opened personal-care, cosmetic, and supplement products are non-returnable except where defective, damaged, or incorrect. Customer-initiated (change-of-mind) returns are customer-paid shipping. An optional +10% store-credit bonus is available when you choose store credit instead of a refund.

9. Health, Safety & Product Disclaimers

Because we sell health and beauty products, the following applies to all applicable items:

  • Dietary supplements (FDA notice). These statements have not been evaluated by the Food and Drug Administration. Dietary supplements and vitamins are not intended to diagnose, treat, cure, or prevent any disease.
  • Use as directed. Always read and follow the manufacturer’s label and directions. Patch-test new skincare or cosmetics before full use. Discontinue use and consult a physician if irritation occurs. Consult a healthcare provider before using supplements if you are pregnant, nursing, taking medication, or have a medical condition. Keep products out of the reach of children.
  • Ingredient & formulation accuracy. Ingredient lists and product information are provided by the manufacturer. Manufacturers may change formulations or packaging without notice. Always rely on the label on the product you actually receive.
  • Allergens. Products may contain allergens. Review the manufacturer’s ingredient list and discontinue use if you experience an allergic reaction.
  • Age-restricted products. Certain products are age-restricted. By ordering, you confirm you meet the legal age to purchase such items in your jurisdiction. We may verify age and decline or cancel orders accordingly.
  • Not medical advice. Product descriptions and any wellness information we provide are for general informational purposes only and are not a substitute for professional medical advice.

10. Acceptable Use

You agree to use the Services lawfully and not to: violate laws or third-party rights (privacy, IP, publicity); upload or post anything unlawful, harmful, threatening, defamatory, obscene, or hateful; impersonate any person or entity; deploy malware, scrapers, or automated means that burden or disrupt the Services; attempt unauthorized access or test vulnerabilities; send spam or unsolicited promotions; or harvest personal information about others without consent. We may suspend or terminate access for violations (see Section 19).

11. Intellectual Property

All content on the Services (text, graphics, logos, images, audio/video, software, design, and arrangement) is owned by Exotic Pro or its licensors and protected by intellectual-property laws. You may use the Services for personal, non-commercial purposes only. No license is granted except as expressly stated. Third-party brand names and logos are the property of their respective owners (see Section 3).

12. Feedback & User Content

If you submit reviews, ideas, suggestions, or other content (“Feedback”), you grant Exotic Pro a perpetual, worldwide, royalty-free, sublicensable license to use, host, reproduce, modify, publish, and display such Feedback in any medium for any lawful purpose. You represent that you own or have rights to the Feedback and that it complies with these Terms and applicable laws.

13. Third-Party Tools & Links

We may provide access to third-party tools or links to third-party sites, provided “as is” and “as available.” We do not control or endorse third-party content and are not responsible for any damages or issues arising from your use of them. Review third-party terms and privacy policies before engaging.

14. Relationship with Shopify

Our store is hosted by Shopify, which helps provide and improve the Services. Purchases are made directly with Exotic Pro. Shopify is not responsible for your transactions with us. You release Shopify and its affiliates from claims related to your purchases and use of the Services. See our Privacy Policy and Shopify’s practices at https://privacy.shopify.com.

15. Privacy, AI & Cookies

Your use of the Services is subject to our Privacy Policy, which explains what we collect, how we use and share data (including cookies and your consent choices), and your rights. As described there, we use AI-assisted tools to improve support, recommendations, security, and logistics, subject to anonymization or aggregation where feasible and applicable law. You may request exclusion by contacting CS@exoticp.com.

16. Errors, Inaccuracies & Omissions

Occasionally the Services may contain errors or omissions (for example, in pricing, availability, or shipping charges). We reserve the right to correct, change, or update information, or to cancel orders, if any information is inaccurate at any time without prior notice (including after you submit an order).

17. Electronic Communications

By using the Services, you consent to receive electronic communications from us (emails, site notices, order updates). These satisfy any legal requirement that communications be in writing. For marketing emails or SMS, you can opt out at any time (see Privacy Policy).

18. Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED BY EXOTIC PRO IN WRITING, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE SERVICE. (Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.)

19. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EXOTIC PRO AND OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, OR SAVINGS; LOSS OF DATA; OR REPLACEMENT COSTS ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO EXOTIC PRO FOR THE PRODUCT(S) AT ISSUE OR ONE HUNDRED U.S. DOLLARS (US $100). (Some jurisdictions do not allow certain limitations; parts may not apply.)

20. Termination

We may suspend or terminate your access (in whole or in part) at any time, with or without notice, for any reason, including violation of these Terms. You remain liable for amounts due up to the termination date. Sections that logically survive will continue to apply (for example, IP, Feedback, Warranty Disclaimer, Limitation of Liability, Indemnification, and Dispute Resolution).

21. Indemnification

You agree to indemnify, defend, and hold harmless Exotic Pro (and our affiliates, directors, officers, employees, agents, contractors, and service providers) from claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services or products; (b) your breach of these Terms; or (c) your violation of laws or third-party rights. We may control the defense and settlement at our option, and you will cooperate fully.

22. Dispute Resolution; Arbitration; Class-Action Waiver

  • Good-faith resolution. Before filing a claim, you agree to contact us at CS@exoticp.com and attempt to resolve the dispute informally within 30 days.
  • Binding arbitration. If not resolved, disputes will be exclusively resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Venue: Orange County, California (or remote/virtual by agreement). Judgment on the award may be entered in any court with jurisdiction.
  • No class actions. YOU AND EXOTIC PRO AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
  • Small claims. Either party may bring qualifying claims in small-claims court in Orange County, CA.
  • Injunctive relief. This section does not prevent either party from seeking temporary or preliminary relief in court to protect rights pending arbitration.

(If a court finds the class-action waiver unenforceable, this arbitration section is severed, and disputes shall be litigated in the state or federal courts located in Orange County, California.)

23. Governing Law & Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Subject to Section 22 (Arbitration), you consent to exclusive jurisdiction and venue in the state or federal courts located in Orange County, California.

24. Assignment

You may not assign, transfer, or delegate these Terms without our prior written consent. We may assign or transfer our rights and obligations without notice.

25. Severability

If any provision is held unenforceable, it will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force.

26. Waiver; Entire Agreement; Headings

Our failure to enforce a provision is not a waiver. These Terms, together with the policies linked here (Privacy Policy, Return & Refund Policy, Shipping Policy), constitute the entire agreement between you and Exotic Pro and supersede prior understandings. Headings are for convenience only.

27. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, labor disputes, supply-chain disruptions, carrier delays, cyber incidents, or governmental actions.
