Welcome to Exotic Pro (“Exotic Pro,” “we,” “us,” “our”). We operate www.exoticp.com and related features, tools, products, and services (collectively, the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.
By visiting, interacting with, or using the Services, you agree to be bound by these Terms of Service (the “Terms”) and our Privacy Policy LINK. If you do not agree, do not use the Services.
1) Access & Accounts

Age & Authority. You represent that you’re at least the age of majority in your jurisdiction and authorized to enter these Terms.

Account Info. You agree to provide accurate, current, and complete information and to keep it updated.

Security. You’re responsible for safeguarding your login credentials and all activities under your account. We strongly recommend strong passwords and two-factor authentication (2FA). You may not sell/transfer your account.
2) Changes to the Terms
We may update these Terms at any time by posting the revised version and updating the “Last Updated” date. We’ll provide notice of material changes as required by law. Your continued use after changes take effect constitutes acceptance.
3) Our Products & Content
We work hard to present products accurately, but display may vary by device/settings. Descriptions, specifications, availability, and pricing may change without notice. We may limit quantities or discontinue items at our discretion.
4) Orders & Acceptance
When you place an order, you make an offer to purchase. We may accept or decline your order at our discretion (including for suspected fraud, pricing/stock errors, or address issues). We must receive and process payment before acceptance. If we cancel or modify an order, we’ll attempt to notify you using the contact details you provided.

5) Prices, Billing & Taxes
Prices, promotions, and discounts may change without notice. The price in your order confirmation is the price in effect at purchase time, exclusive of taxes, shipping, handling, customs, and import charges unless stated otherwise.
You agree to provide current, complete, and accurate payment information and authorize us (and our payment processors) to charge your selected payment method for all amounts due.
6) Shipping, Title & Risk of Loss
Please see our Shipping Policy LINK for carriers, costs, and timelines. Delivery times are estimates only. Once an order is tendered to the carrier, title and risk of loss pass to you. We are not liable for carrier delays, customs processing, or events outside our control.
7) Returns, Refunds & Exchanges
Returns, refunds, and exchanges are governed by our Return & Refund Policy LINK. Among other terms, eligible returns must be initiated within 30 days, in original condition with manufacturer seals intact. Customer-initiated returns (no fault of Exotic Pro) are customer-paid shipping. Bonus +10% store credit is available when you choose store credit (see policy for details).
8) Acceptable Use (Prohibited Conduct)
You agree to use the Services lawfully and not to:

violate laws or third-party rights (privacy, IP, publicity);

upload/post anything unlawful, harmful, threatening, defamatory, obscene, or hateful;

impersonate any person/entity or misrepresent your identity;

deploy malware, scrapers, or automated means that burden or disrupt the Services;

attempt to gain unauthorized access or test vulnerabilities;

send spam, chain letters, or unsolicited promotions; or
-
harvest/collect personal info about others without consent.
We may suspend or terminate access for violations (see Section 18).
9) Intellectual Property
All content on the Services (text, graphics, logos, images, audio/video, software, design, and arrangement) is owned by Exotic Pro or its licensors and protected by IP laws. You may use the Services for personal, non-commercial purposes only. No license is granted except as expressly stated.
“Exotic Pro” names, logos, and marks are trademarks of Exotic Pro. Other names/logos are property of their respective owners.
10) Feedback & User Content
If you submit reviews, ideas, suggestions, or other content (“Feedback”), you grant Exotic Pro a perpetual, worldwide, royalty-free, sublicensable license to use, host, reproduce, modify, publish, and display such Feedback in any medium for any lawful purpose. You represent you own/have rights to the Feedback and that it complies with these Terms and applicable laws.
11) Optional Tools & Third-Party Links
We may provide access to third-party tools or link to third-party sites. These are provided “as is” and “as available.” We don’t control or endorse third-party content and aren’t responsible for any damages or issues arising from your use of them. Review third-party terms and privacy policies before engaging.
12) Relationship with Shopify
Our store is hosted by Shopify, which helps provide and improve the Services. Purchases are made directly with Exotic Pro. Shopify is not responsible for your transactions with us. You expressly release Shopify and its affiliates from claims related to your purchases and use of the Services. 13) Privacy; AI & Cookies
Your use of the Services is subject to our Privacy Policy LINK, which explains what we collect, how we use/share data (including cookies), and your choices/rights.
As described in our Privacy Policy, we may responsibly use certain customer information to train and improve internal AI tools to enhance support, recommendations, security, and logistics—subject to anonymization/aggregation where feasible and applicable law. You may request exclusion by contacting cs@exoticp.com.
14) Errors, Inaccuracies & Omissions
Occasionally the Services may contain errors or omissions (e.g., pricing, availability, shipping charges). We reserve the right to correct, change, or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you submit an order).
15) Electronic Communications & Notices
By using the Services, you consent to receive electronic communications from us (emails, site notices, order updates). These satisfy any legal requirement that communications be in writing. For marketing emails/SMS, you can opt out at any time (see Privacy Policy).
16) Disclaimer of Warranties
EXCEPT AS EXPRESSLY STATED BY EXOTIC PRO IN WRITING, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE SERVICE.

17) Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, EXOTIC PRO AND OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS/REVENUE/SAVINGS; LOSS OF DATA; OR REPLACEMENT COSTS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS WILL NOT EXCEED THE AMOUNT YOU PAID TO EXOTIC PRO FOR THE PRODUCT(S) OR ONE HUNDRED U.S. DOLLARS (US $100), WHICHEVER IS GREATER.

18) Termination
We may suspend or terminate your access (in whole or part) at any time, with or without notice, for any reason, including violation of these Terms. You remain liable for amounts due up to the termination date. Sections that logically survive will continue to apply (e.g., IP, Feedback, Warranty Disclaimer, Liability, Indemnity, Dispute Resolution).
19) Indemnification
You agree to indemnify, defend, and hold harmless Exotic Pro (and our affiliates, directors, officers, employees, agents, contractors, and service providers) from claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services/products; (b) your breach of these Terms; or (c) your violation of laws or third-party rights. We may control the defense/settlement (at our option), and you’ll cooperate fully.
20) Dispute Resolution; Arbitration; Class-Action Waiver

Good-Faith Resolution. Before filing a claim, you agree to contact us at cs@exoticp.com and try to resolve the dispute informally within 30 days.

Binding Arbitration. If not resolved, disputes will be exclusively resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Venue: Orange County, California (or remote/virtual by agreement). Judgment on the award may be entered in any court with jurisdiction.

No Class Actions. YOU AND EXOTIC PRO AGREE THAT EACH MAY BRING CLAIMS ONLY IN YOUR/ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Small Claims. Either party may bring qualifying claims in small-claims court in Orange County, CA.

Injunctive Relief. This section doesn’t prevent either party from seeking temporary or preliminary relief in court to protect rights pending arbitration.
(If a court finds the class-action waiver unenforceable, this arbitration section is severed, and disputes shall be litigated in state/federal courts located in Orange County, California.)
21) Governing Law & Venue
These Terms are governed by the laws of the State of California, without regard to conflict of laws rules. Subject to Section 20 (Arbitration), you consent to exclusive jurisdiction and venue in the state or federal courts located in Orange County, California.
22) Assignment
You may not assign, transfer, or delegate these Terms without our prior written consent. We may assign or transfer our rights/obligations without notice.
23) Severability
If any provision is held unenforceable, it will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force.
24) Waiver; Entire Agreement; Headings
Our failure to enforce a provision is not a waiver. These Terms, plus policies linked here (e.g., Privacy Policy, Return & Refund Policy, Shipping Policy) constitute the entire agreement between you and Exotic Pro and supersede prior understandings. Headings are for convenience only.
25) Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, labor disputes, supply chain disruptions, carrier delays, cyber incidents, or governmental actions.
